Next steps The functioning of the EU-US framework for personal data protection will be subject to periodic reviews carried out by the European Commission in collaboration with representatives of the European data protection authorities and the relevant US authorities. The first review will take place within one year of the entry into force of the adequacy decision and will verify that all relevant elements have been fully implemented in the US legal framework and work effectively in practice.
Context Article 45(3 ) of the General Data Protection Regulation empowers the Commission to decide, by means of implementing acts, that a third country ensures "an adequate level of protection", i.e. a Mobile Phone Number level of protection of personal data that it is essentially equivalent to the level of protection in the EU. As a result of an adequacy decision, personal data can be freely transmitted from the EU (and from Norway, Liechtenstein and Iceland) to a third country without further obstacles.
Following the invalidation of the previous adequacy decision on the EU-US Privacy Shield by the Court of Justice of the EU, the European Commission and the US government began discussions on a new framework to address the issues raised by the Court .
